FMCS Labor Arbitrator

Arbitrator David E. Wilson


With over Forty years of years of labor and employee relations experience in the manufacturing, automotive, mining, packaging , distributon transportation, foundry and chemical industries I provide a fair and balanced perspective to labor arbitration.  Starting on the factory floor as a production worker, I have also held first line supervisory and second shift superintendent positions in manufacturing and distribution.  While working full time as a Labor Relations Manager I attentdd law school at night earninig my Juris Doctorate degree.

Upon admission to the Bar I joined Eagle Picher Industires. At that time Eagle Picher was a diversified manufacturing company with 50 plants in the United States serving the automotive, chemical and industrial markets.

While at Eagle Picher I negotiated over 40 labor agreements with the United Auto Workers, Teamsters, Steelworkers, Graphic Communication Wokrkrs, Ironworkers and Operating Engineers Unions.  In addition I served as first chair in numerous arbitrations and negotiated settlements of hundreds of griveances during my career.The combination of my knowledge of contract interpretation principles and due process in discipline and discharge cases and my work experience enables me to bring an understanding of the dynamics of the shop floor to the arbitration process.

Fees and Policies

  • Per diem rate is $1,100 for hearing days and for research and preparation of the award.  A hearing day is up to eight hours.  Hearing days in excess of eight hours and time for research and preparation of the award are prorated.
  • If the hearing is cancelled or adjourned with noticue of less than twenty-one (21) calendar days, the per diem for each day of hearing scheduled shall be charged unless another matter can be scheduled in its place.
  • Expenses:    Actual  costs of reasonable  expenses  including airfare  (lowest  fare  available), car rental,  food and lodging.    Automobile mileage is  charged at  the  current IRS  rate.
  • Travel  time:  $137.50  per hour  is  charged  for  travel time  up  to  four  hours.    Travel longer  than four  hours is  charged at the  per diem  rate.    Travel time and mileage  are  calculated from  the billing address  closest to  the  hearing location.    There  is  no  charge  for  travel within  a  50  mile  radiu of Cincinnati,  Ohio.
